Abstract

“Mobbing” describes severe forms of harassment in organizations and has been defined as a series of vertical or horizontal systematic violence in the hierarchy of the company and that harms the victim in many areas, including social, family, psychological and physical. The bully often used strategies to attack the person’s own conditions of their work, communication, open violence or the stability of the subject in the group. The victim is usually a very competent and outstanding hardworking, cooperative, committed that may occur at various stages of clinical manifestations ranging from anxiety and depressive symptoms until later consequences on emotions, thinking and worldview. The forensic assessment is complex and must be done in a comprehensive and detailed. In Costa Rica’s largest regulatory framework actually missing from both administratively and judicial difficult typing and indirectly lack the forensic analysis in the light of specific law or regulation; In fact, the Costa Rican Penal Code makes no explicit reference to the concept of bullying and there is no specific law on the issue, which makes the approach to be performed from several perspectives.
