The purpose of this essay is to start form the specialized legislation that give us a judicial practice that have in mind the rights of the youth victims. To do this we are going to refer to the preventive perspective, and verify if is possible to prevented the abuse from the optic give us for the superior interest of the childhood and his legal and constitutional legislations. We try to conceptualize the abuse and their manners that it appear in the infant level together to mitts and false bevels that can influence the judicial decisions, and we study the victimlogy like a scientific discipline, and his new influences in favor of the childhood. At the ending we understood the existence of procesales limits that do not permit an optimums execute of this particular restorative penal justice.
