This article addresses the topical issue within the medical liability: the obligation of means and results. While the result is prevalent in any physician-patient relationship, there are specialties like plastic surgery, radiology, radiotherapy, pathology and anesthesia, in which this obligation of result has been a part of many of its procedures. Based on these assumptions, it is review explored actions of Argentina and Spain jurisprudence; and it shows how they have evolved to analyses each case individually in order to deliver the verdict and a likely compensation.
