Abstract

The 2306-2006 vote of the Costa Rican Constitutional Court ( about the in vitro fecundation), has made "Copernicans" revolution on the concept of "human person" and the legal protection given to them. The Court spread the use of the word "human person" to every human being including the unborn, called in our legislation, "fetus". This definition modified the Civil Code which expresses " The existence of the human person are begins at a living birth" and affects as well the Family Code because the rights and obligations now given to the unborn.
